January 2009 Newsletter




Gardening & Maintenance

We are unable to employ a gardener/maintenance man due to the dire financial situation. Lucas has worked extremely hard since November last year, strimming, clearing circles and generally keeping the park tidy, he has received no payment for this.

We have now reached an agreement where he will work as self employed being responsible for his own taxes and social security.
He has agreed to work 10 days each month and invoice us accordingly. Hopefully later in the year we will be in a better position to offer him more work.

Last week we experienced 120 mph winds which resulted in some damage. The electricity box outside Clara’s caravans was blown over, Lucas has repaired it and made it safe, this will be included in this month’s invoice.

Electricity Bill




An after xmas shock, the highest electricity bill ever received on Mi-Sol. Thankyou to those owners who have paid thier bills. It has been colder this winter than previous years but to those who are querying the retrospective amounts and the general increase in price of electricity please bear in mind that €10,406.13 has been deducted from the Mi-Sol bank account for one month's usuage. It is imperative that your utility bills are paid promptly to cover the monthly direct debit.

Pool Payment

Some of you may have noticed from the last post that the pool payment for August 2008 included maintenance. Considering the pool was not functional until the third week in August I thought this was a bit of a liberty. I brought it to the pool contractor's attention last month and he said he would have to consult with his paperwork. Yesterday when he called for his payment he agreed and we will be deducting the €500 from next month's payment. As we are now a month behind with our payments, I asked him for an extension to the contract end date and he agreed. He has also agreed to complete the tiling around the pool area in February.

At a committee meeting last year it was agreed to disenable all but one of the shower blocks, last week I asked an electrician to disconnect the wiring from shower block 2. On inspection this week it was found to still have hot water and so the boilers have been removed. There are still toilet facilities and cold water as there are in shower block 3.

Lucas has worked very hard strimming and generally keeping the park tidy, he has not received any payment for this work. I am meeting with him tomorrow to put a proposal to him so that he may be able to earn some money without Mi-Sol being committed to a contract.

Pool expense & contact information




We are currently updating owner information for our records. This is a requirement by law and I would appreciate your co-operation. I have posted a copy of the standard template which can be completed and returned by email.

Several owners have requested a break down in the expenditure for the swimming pool, as you are aware we are paying by instalments, the next one due this week. It is hoped that we can fulfill our obligation to the Pool contractors by July 2009.

Latest update

Following the suspension of Apyme who were acting as Secretary for Mi-Sol, I have asked Peter Hopkins to take over the role and he has very kindly agreed.

Friday 16th January we had a meeting with Rosario and I will post the notes taken.

It was agreed at a committee meeting last year to disenable the shower blocks, it was decided to keep one open as we are legally obliged to provide this facility bearing in mind that technically we are still a 'camping' site; we are not obliged to provide hot water. Therefore it was a surprise for me to be told that Shower block 2 was still functioning with hot water and was being used for ablutions and laundry. I arranged for the boiler to be disconnected and the next day was confronted with an irate owner complaining that he couldn't have a hot shower even though he has this facility in his own property. He offered to pay for the re-wiring of the boiler, I explained that we are all getting a little weary of subsidising those who abuse this facility. If I find that re-wiring has taken place; I will have the boiler removed permanently.

I have had several meetings with Clara and Peter Hopkins as translator, she informed us that her property 610 was not connected to the Mi-Sol electricity system and therefore shouldn't be charged as such. She produced receipts from Iberdrola confirming this, it was also confirmed that this property consists of one house not two as were led to believe. She invited us to inspect the property which was done and it is correct, she only has one house on that plot. I told Clara that the meter would be removed, it has been recording usuage and we need to find out who has been using this. She agreed and the meter was removed yesterday. Who will come knocking at the door I wonder.

At the open forum last Tuesday it was mis-informed that Lucas is being paid out of petty cash for the gardening work he has been doing, this is not true, I have credited their account with 150 Euros for November on the understanding that they maintain regular monthly payments. It has not been agreed to credit their account every month. Lucas has been working on his own volition to which we are grateful as the park is looking a lot cleaner and tidy.

There has also been the misconception that monthly payments for fees are not acceptable, again this is not true, we welcome payment in any form whether it be monthly or not. It is not necessary to wait for the bills to be distributed, an old bill will suffice and any amount of payment can be made. Please ensure that your plot number is recorded on your bank receipt for our records and to enable us to credit your account.

There has been some true community spirit shown of late and a thankyou is in order; to Bill who cemented a ramp at the bottom gate so that wheel chair owners can use that exit, Jim who made the gaping manhole by the pool safe, the electrician for removing the electric meter and disenabling the boiler, Tony for monitoring the pool pump, saving us a little electricity and Bill our loyal postie who never fails us. Thankyou to those who when called upon man the office and to Pat who has put a lot of hours in getting our database up to scratch.

Letter to APYME

Owners Open Forum 13th January 2009

An owners open forum was held at the bar on Tuesday 13th January and it was pleasing to see that roughly 50 people attended. On Monday I still had not received the information from APYME with respect to owners bills. Considering the fact that they send this information via email and it then has to be checked, printed and sent out it was obviously going to be another two or three days before any bills were out on receipt. Therefore I decided to obtain the information from the Mi-Sol database so that monies could be paid into Banco Popular to cover the next electricity bill due next week. A lot of work has gone into getting our own database up to date. It has been normal after receiving the information from APYME in the past that there were errors which had to be rectified. I ask all owners to bear with us, if you find any discrepancies with your account please make arrangements to return your bill to us and it will be corrected.
In December last year I successfully negotiated with APYME a reduction in their fee to 700 Euros per month. Antonio requested that future payments be made by Standing Order from our bank, I agreed to set this up this month, so it was a surprise to see that on Saturday 10th January, 707.00 Euros had been paid to APYME direct from the bank when I hadn't authorised or signed anything. I called at Banco Popular Monday morning and was told that there must be an old standing order outstanding, I have to dispute this because I am confident that my predecessors did not make such an arrangement. I cancelled the order. I assume the extra 7 Euros is tax this amazes me as we have been paying almost 500 Euros each quarter for their tax!
At the committee meeting held 8th January it was unanimously agreed to suspend the services of APYME until further notice, this has been done and I have posted the letter that has been written to them.

Bank Statement





The latest bank statement shows the situation to date. Last month during one of the many meetings with Paco he said he would pay December's water bill on proof of payment. I gave him a copy of the bank statement showing Aguamed had taken out the money but he wanted the bill which didn't arrive until last week. Today I took him the bill and he said he couldn't pay it because it has already been paid. I tried to persuade him to withdraw the amount from Caja Rural and put the money into Banco Popular to which he replied, not until we have a resolution to the problems. I have been advised by Rosario, our lawyer, to give Aguamed the account number of Caja Rural so payment can be taken out by Direct Debit, the problem with this is I do not have access to the balance in that bank account and cannot say for certain that there will be enough funds to cover the monthly bill.

Paco is insistent that the pending court case in Madrid has nothing to do with Mi-Sol, it is a private concern against Pepe. The paperwork given to me by Rosario clearly states it is against Pepe representing Mi-Sol. Paco's advise is for neither side to attend the court in Madrid and it will be finished. My previous legal experience tells me that this statement is not true. I will continue to act on the advise of Rosario, which is to publish a debtors list and submit information regarding those owners owing more than 900 Euros so court proceedings can commence, this I intend doing.
